Beastie Boys’ Ad-Rock Takes the Stand in Monster Lawsuit

The iconic hip hop group sued the energy drink company in 2012 after unauthorized use of their songs in an ad campaign

Following the death of founding Beastie Boys member Adam “MCA” Yauch in 2012, Monster Energy Drinks released a video advertising campaign where they used five Beastie Boys songs during the video: “Sabotage,” “So What’cha Want,” “Pass the Mic,” “Make Some Noise” and “Looking Down the Barrel of a Gun.”

This, of course, was a direct violation of Yauch’s will, which stated that his likeness or art, including that of what he created as a member of the Beastie Boys, was never to be used in an advertisement.

The remaining Beasties, Adam “Ad-Rock” Horovitz and Michael “Mike D” Diamond subsequently filed a lawsuit against Monster Beverage Corp.

The case has now gone to trial, with Billboard reporting that Horovitz has taken the stand first.

Ad-Rock and Mike D are seeking $1 million in damages for using the songs as a Beastie Boys ‘megamix’ in their ad for a snowboarding event in Canada, entitled “Ruckus in the Rockies.”

They are also seeking an additional million for “implied endorsement.”

The defense has since called Monster’s usage of the songs a “mistake.”

While Ad-rock took the stand, he discussed the origins of the Beastie Boys’ career, and said he and the other members were “very lucky” with how far they had come.

The case is expected to last one week.

If you recall, this isn’t the first Beasties lawsuit in recent time; in March, they settled with toy company GoldieBlox after their video went viral where they spoofed the group’s 1987 single, “Girls.”
