Another blow is dealt to the Winklevoss twins in their continued saga to sue Facebook and its founder Mark Zuckerberg for more than the already agreed on settlement of $65 million.

On Friday U.S. district judge Douglas Woodlock dismissed a second lawsuit by Tyler and Cameron Winklevoss, a month after they and business partner Divya Narendra abdicated a possible appeal to the U.S. Supreme Court.

In the original case which was settled in 2008, the twins and their business partner alleged that Zuckerberg stole their idea for Facebook. At the time of the settlement, the Winklevosses and Narendra said that they were led to believe that the 1.2 million shares they received in the settlement we worth almost $36 each, when they were actually worth $8.80 each.

Facebook has been valued over $100 billion and is preparing for the msot sought after IPO in recent memory. In the secondary market, Facebook shares have traded for over $70 each, and are expected to fetch even more once the social media giant goes public.

Recently, the former president of Harvard Univertsity, Larry Summers, who was the president at the time the twins were attending the university, said at Fortune's Barinstom Tech conference: "One of the things you learn as a college president is that if an undergraduate is wearing a tie and jacket on Thursday afternoon at three o’clock, there are two possibilities. One is that they’re looking for a job and have an interview; the other is that they are an a**hole. This was the latter case.”

It is still unknown whether or not the Winklevosses plan to proceed further with their case.
