Israeli Court Convicts Fogel Family Murderer

On Tuesday, the Samaria District Military Court convicted Hakim Awad, 18, for the murders of five members of the Fogel family back in March.

The murders took place in the West Bank settlement of Itamar. Five members of the Fogel family were brutally stabbed to death in their own home on the night of March 11. Ehud and Ruth Fogel, along with three of their young children; Yoav, 11; Elad, four; and Hadas, three-months-old were all murdered.

Awad, from the nearby village of Awarta, pleaded guilty to the murder charges as well as to a series of weapons-related and security offences. Hakim and Amjad Awad, who were both involved in the murders, were formally charged with five counts of intentionally causing death, stealing weapons, breaking and entering and conspiracy to commit a crime.

Amjad, 19 has pleaded guilty to the crimes as well, however his trial is still ongoing. Military prosecution in the case say that there is forensic evidence, such as DNA samples and fingerprints, linking the two defendants to the scene of the crime.

During his trial, Hakim said that the Fogel children had looked at him and Amjad through the house blinds. After conducting the murders, the two defendants fled the scene and attempted to hide the evidence. Hakim said that upon a threat to return to Itamar in order to commit another murder, his uncle helped him to conceal his weapons and blood-soaked clothes.

Despite the confession, during which Hakim showed no emotion, the judges decided to examine some of the prosecution’s evidence.

“The reason behind the decision is that the event in question caused shock both in Israel and abroad and there is an element of suspicion – however ludicrous this may sound – that a person will claim responsibility for an act he did not commit for the sake of ‘glory,’” said Presiding Judge, Menachem Lieberman.

The court will begin discussing sentencing arguments for Hakim Awad’s case in September and will hear testimonies from the Fogel family. The prosecution has stated that it does not intend to seek the death penalty. The case against Amjad Awad will resume on August 16.
